Kenya: Scammer poses as woman to car seller

A man was charged in Kibera Magistrates' Court for obtaining money under false pretences yesterday in Kenya. He was accused of defrauding a businessman by posing as a woman.

The scammer wanted to buy a car in an online purchase

Bob Ngome Nyongesa is accused of obtaining Sh150,000 from Said Mwangi Ali after posing as a prospective buyer of his Mercedes Benz car. The complainant had put it up for sale on an online marketing platform. Posing as a potential buyer, he had a conversation with Ali while he was allegedly travelling from Narok to Nairobi to view the vehicle.

Nyongesa was convicted of a similar offence in 2012 by a Kakamenga magistrate

According to the Directorate of Criminal Investigation (DCI), Nyongesa told Ali that he wanted to buy the motor vehicle, a Mercedes Benz, for Sh1.4 million. He asked for more pictures of the vehicle posted on the online platform, before travelling to Nairobi where they were to conclude the deal.

Convinced that Nyongesa was a serious buyer, Ali sent him more pictures, including of the interior and other parts of the car.

Nyongesa then allegedly contacted Ali to inform him that he had hit several cows and goats belonging to Maasai herdsmen and that he needed money to settle the matter before he was lynched. To convince Ali, the suspect allegedly sent him pictures of cattle carcasses lying on a road and of his allegedly damaged vehicle. Nyongesa, who was posing as a woman, told Ali that the herdsmen were about to lynch him if he did not pay 150,000 shillings. He asked Ali to send him the money, promising to pay him back when he bought the car, after gaining access to banks in Nairobi. He stopped communicating with Ali as soon as he received the money.

Nyongesa was arrested by detectives from the Langata DCI offices at his home in Rongai on 10 April. He allegedly posed as a white woman called Ryan Britney to defraud unsuspecting Kenyans. The prosecution asked the court to consider the fact that Nyongesa is a known fraudster and that several people filed complaints against him after his arrest. Nyongesa denied the charges before Senior Principal Magistrate Esther Bhoke. He was released on Sh300,000 bail and an alternative cash bail of Sh200,000.

In the previous case in which he was convicted, Nyongesa was accused of obtaining money by false pretense in violation of Section 313 of the Penal Code. The details of the offence were that on 26.11.2012 in Lubao area of Kakamega Central, with intent to defraud, he obtained from Mohammed Abdallah Osman the sum of Sh250,000 by pretending that he could sell him six kilograms of gold, which he knew to be false. He was convicted of the offence and sentenced to 18 months in prison. He appealed to the Kakamenga High Court and lost on appeal to Justice Said Chitemwbe in a judgment delivered on 18 September 2014.
